Terms of use

01Accounts

You must be at least 18 years old and able to enter into a binding agreement. If you use the Service for a business, you confirm that you can bind that business to these Terms.

Keep your account details accurate and your password and API keys private. You are responsible for all activity under your account and your keys. Tell us promptly if you believe they have been misused, and revoke any key that may have been exposed.

02The Service

Appsify lets app owners run an affiliate and referral program for their apps: referral codes and links, attribution of merchants to affiliates, commission calculation in a ledger, a holding period, refund and chargeback clawbacks, payout requests and a hosted affiliate portal.

Attribution depends on the data your app sends us and on what each marketplace allows. Marketplace installs cannot carry referral links, so attribution relies on referral codes and, where used, IP matching. We do not guarantee that every referral will be attributed.

03App owners

• You set your program’s commission rules and decide which affiliates to work with. Your agreement with your affiliates, including commission terms, is between you and them.
• You pay your affiliates yourself, for example by PayPal. Appsify calculates and records commissions and shows payout requests, but does not hold, transfer or guarantee any money owed to affiliates.
• You are responsible for the accuracy of the events your app sends us, and for having a lawful basis to share information about your merchants and affiliates with us and telling them about it.
• You must comply with the rules of the marketplaces you sell on and with applicable laws, including marketing, consumer protection and privacy laws.

04Affiliates

• When you join a program, your relationship is with that app’s owner. The owner sets the commission, approves payouts and pays you. Appsify is not a party to that arrangement and does not pay commissions.
• Commissions shown in the portal are held for a period before they become available, and can be reversed if the merchant is refunded or charges back.
• You must promote apps honestly. Do not refer yourself, use fake or incentivised sign-ups the owner has not approved, send spam, or misrepresent an app or its owner.

05Acceptable use

You must not:

• send fraudulent, fabricated or duplicate referrals or billing events;
• use the Service for unlawful, deceptive or abusive activity;
• try to access another user’s program, data or account, or bypass security or usage limits;
• interfere with or overload the Service, or probe it for vulnerabilities without our written permission;
• copy, resell or reverse engineer the Service, except where the law allows it.

We may suspend or remove programs, referrals or accounts involved in fraud or abuse.

06Plans, billing and trials

• Plans are billed per app. Each app you run a program for needs its own plan.
• When you add an app, it starts a 14-day trial. To keep the program running for that app after the trial, choose a plan.
• Monthly: $14.95 per month per app. It renews each month until you cancel.
• Lifetime: $249 one time per app, for access to the Service for that app for as long as we operate the Service.
• Checkout and payments are handled by PayPro Global, which may act as the reseller of record and apply its own terms. Prices exclude any taxes that apply.
• We may change prices for future billing periods. We will tell you before a change affects your plan.

07Cancellation and refunds

You can cancel a Monthly plan at any time by emailing support@appsify.com. Cancellation stops future renewals; the current month is not refunded.

Lifetime purchases come with a 30-day money-back guarantee: email us within 30 days of the purchase for a full refund.

Where the law gives you further rights to a refund, those rights apply.

08Your data and ours

You keep ownership of the data you and your app send to the Service. You give us permission to use it to provide, secure and improve the Service, as described in our Privacy policy.

The Service, its software, design, text and branding belong to us or our licensors. These Terms do not transfer any of those rights to you.

09Availability and changes

We work to keep the Service available, but it may be interrupted for maintenance, updates or reasons outside our control. We may change or discontinue features. If we discontinue the Service entirely, we will give reasonable notice so you can export your program records.

10Suspension and termination

You can stop using the Service and ask us to close your account at any time. We may suspend or close an account that breaches these Terms, is used for fraud, or creates risk for other users, and we will tell you why unless the law or a security reason prevents it.

11Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any level of referrals, sales, revenue or affiliate performance.

12Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. We are not liable for amounts owed between app owners and affiliates.

Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.

13Indemnity

You agree to defend and indemnify us against claims, losses and costs arising from your program, your apps, your agreements with affiliates or merchants, the data you send us, your breach of these Terms or your violation of law.

14Governing law and disputes

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules, except where mandatory consumer protection laws require otherwise. Disputes will be brought in the competent courts of Hong Kong, where the law allows.

15Changes to these Terms

We may update these Terms. The updated version will be posted on this page with a new date, and if a change is significant we will tell account holders before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
